RISKWISE: AI POLICY

BACKGROUND

This AI policy (“AI Policy”) explains how artificial intelligence (“AI”) enabled functionality and technologies are used by S2 Group in the delivery of the Services. S2 Group is always trying to improve the service it provides, and it is with that in mind that it offers and utilises AI-enabled functionality and technologies.

This AI Policy is to be read alongside our Software Licence Agreement, as agreed with you, or, where you are an individual, your employer. Where there is any conflict or inconsistency between the provisions of this AI Policy and those of the Software Licence Agreement, the provisions of this AI Policy prevail.

Any defined terms used in this AI Policy but not defined are to be interpreted as the meaning given to them in the Software Licence Agreement.

APPLICABLE TERMS

1. The AI-enabled functionality and technologies made available by S2 Group shall constitute part of “RiskWise”, as defined in the Software Licence Agreement, and all provisions contained therein relating to RiskWise in respect of use by the Client, liability of S2 Group, Intellectual Property Rights, Data Protection and Confidentiality shall apply. For the avoidance of doubt, any AI-enabled functionality and technologies shall not form part of RiskWise for the purposes of any Service Level Agreement.
2. The Client may elect to use the AI-enabled functionality and technologies made available within the Services. Such functionality is optional and may be enabled or disabled, by the Client, in accordance with the Service configuration and any applicable licence purchased by the Client.
3. Use of any AI-enabled functionality and technologies is subject to the Fair Use Policy and any use restrictions and conditions as set out in the Software Licence Agreement. The Client acknowledges that AI-enabled functionality and technologies may be restricted, suspended, or subject to additional charges where agreed usage limits are exceeded.
4. S2 Group provides the AI-enabled functionality and technologies on an ‘as is’ basis. In particular, S2 Group does not warrant that any outputs generated, modified, adapted, copied, or otherwise provided by the AI-enabled functionality and technologies (“outputs”) will be accurate, complete, error-free, or fit for any particular purpose.
5. The Client acknowledges that outputs are provided automatically and may contain inaccuracies, omissions, or incomplete information. Such outputs are provided to assist users and should not be relied upon for operational, legal, regulatory, financial, or safety-related decisions. The Client remains responsible for reviewing and validating any output(s) before use.
6. Where the Client uses AI-enabled functionality and technologies, the Client acknowledges that any information and data (including confidential data of the Client and personal data of the Client, its staff, representatives, customers and others (“Client Data”)) submitted to such functionality and technologies may be processed by S2 Group and/or its approved third-party AI service providers solely for the purpose of delivering the requested functionality and technologies, and, in the case of personal data contained in Client Data, in accordance with S2 Group Data Protection Policy.
7. Client Data submitted to or processed by AI-enabled functionality and technologies forming part of the Services shall not be used to train or improve any artificial intelligence or machine learning models, whether operated by S2 Group or any third party, unless expressly agreed in writing by the Client.
8. Client Data processed through AI-enabled functionality and technologies shall not be retained for longer than is reasonably necessary to provide the relevant functionality and the resulting data stored within RiskWise shall be handled in accordance with S2 Group's Data Retention Policy, applicable data protection legislation, and any retention requirements imposed by law.
9. Client warrants that it shall only provide such information and data to the AI-enabled functionality and technologies as it is authorised to do.
10. Where the Client uses AI-enabled functionality and technologies, the S2 Group may transfer personal data to the additional sub-processors as set out in Section B of the List of Approved Sub-Processors (at https://support.s2riskwise.com/hc/en-gb/articles/52037897700113-RiskWise-Sub-Processors ).
11. S2 Group may utilise AI-enabled functionality and technologies in the provision of the Services in accordance with this AI Policy, provided that such use remains subject to S2 Group's confidentiality, security, and data protection obligations under the Software Licence Agreement.
12. S2 Group reserves the right to modify, suspend, replace, or withdraw any AI-enabled functionality and technologies at any time and for any reason. Where S2 Group does so, it will use reasonable endeavours to provide notice, as soon as is reasonably and commercially practicable.
